ImageCat User Service Agreement

This English version is provided for convenience. If any inconsistency exists between the English and Chinese versions, the Chinese version shall prevail.

To use the related services provided by the ImageCat app (the "Service"), please read this Agreement carefully, fully understand all of its terms, and choose whether to accept it. In particular, please pay special attention to any clauses concerning disclaimer or limitation of liability, governing law, and dispute resolution. By registering, signing in, or otherwise using the Service, you are deemed to have accepted all terms of this Agreement, which constitutes a legally binding document between you and ImageCat.

If you do not have the civil capacity required under the laws and regulations of the People's Republic of China to carry out the relevant acts, please read this Agreement with your guardian and obtain the guardian's consent before using the Service. If you lack such civil capacity, you and your guardian shall bear all consequences arising therefrom in accordance with law.

Please confirm that, under the laws of the People's Republic of China, the laws of your place of residence, and any other laws that you voluntarily or mandatorily accept, you have the right to enter into this Agreement and be bound by it. If you are acting on behalf of your employer or organization, you represent and warrant that you have sufficient authorization to do so.

Special reminder: any services or content in the Service that involve artificial intelligence models are automatically generated by AI and may contain errors or omissions. We make no guarantee or commitment regarding the accuracy, completeness, or functionality of generated content. Such content does not represent our position or opinion. When using the Service for image enhancement, AI editing, or similar functions, you do not obtain professional aesthetic, copyright, or other specialized advice. If you require such advice, please consult a qualified professional. We are not liable for any loss or liability caused to you or any third party through use of the Service.

1. Service Content

  1. The Service refers to the functions and services we provide through ImageCat, including text-to-image generation, reference-image editing, voice-assisted prompt input, multi-round image creation, doodle-based editing, comparison, image export, and related features. We may change the content of the Service and provide corresponding notice to users.
  2. We only provide technical services related to ImageCat. Any equipment required for network access, such as computers, mobile phones, or other devices, and any costs associated with Internet or mobile network access are borne by you.

2. Registration and Sign-In

  1. You may sign in to ImageCat using your Apple, Google, or WeChat account. Each sign-in provider is treated as a separate ImageCat account and accounts are not automatically merged, even if they belong to the same person or use the same email address.
  2. When registering an account or authorizing sign-in, you shall provide true, accurate, and complete information as prompted and update such information promptly if it changes. Account names, avatars, and other registration information may not contain unlawful or inappropriate content. ImageCat may refuse registration or, after registration, require correction, suspend use, or deregister an account if such issues are identified.
  3. You understand that when you register successfully and use a third-party account to sign in, ImageCat cannot independently identify unauthorized use of that third-party account. Therefore, ImageCat is not liable for any use of the Service carried out through your signed-in account, provided that such use was not caused by our fault.
  4. If your account is used without authorization or any other security issue occurs, you shall promptly notify ImageCat. You understand that any action taken by ImageCat in response requires reasonable time and may not be able to prevent or stop the consequences from arising or expanding.
  5. You shall not include unlawful or inappropriate information in account registration materials and shall comply with applicable laws, public order, social morality, and the authenticity requirement of online information.
  6. You are solely responsible for all activities conducted under your registered account and for all risks arising from your reliance on any content available through the Service.

3. User Conduct

  1. You agree to use ImageCat in good faith and in compliance with this Agreement and applicable law. You shall not use the Service for unlawful activities or for activities that infringe the rights or interests of others.
  2. You shall not obtain or use information belonging to other users by unlawful means, attack or interfere with the Service technically, reverse engineer or decompile the Service, use our name, trademarks, trade dress, or content without authorization, or otherwise infringe our intellectual property or legitimate rights and interests.
  3. You shall not use the Service for commercial purposes unless separately authorized in writing by ImageCat.
  4. If you violate the foregoing, ImageCat may report the relevant conduct to competent authorities or judicial bodies.
  5. You shall ensure that any information or images uploaded to the Service do not contain unlawful content, misinformation, malicious code, or content that infringes the rights of others. You must ensure that you own or are duly authorized to use the copyrights, portrait rights, or other rights necessary for any uploaded image.

4. User-Generated Content

All information you generate on ImageCat in any form shall comply with applicable laws, regulations, platform rules, social morality, and the legitimate rights of third parties. If we discover that content generated through ImageCat violates the foregoing requirements, we may process, remove, or restrict such content.

5. Intellectual Property

  1. We hold the relevant rights in the materials protected by intellectual property or other laws that are contained in the ImageCat services and software. The intellectual property in the overall content of ImageCat, including but not limited to design, graphics, product and service names, belongs to us unless otherwise specified.
  2. ImageCat owns intellectual property in its proprietary content, original content, and content obtained under exclusive or sole authorization. Without our written permission, no individual or entity may copy, reproduce, distribute, or otherwise use such content in a way that infringes our rights.
  3. The intellectual property in the results generated from editing your uploaded images belongs to you, but we may use relevant data internally for product optimization to the extent permitted by law.

6. Privacy Protection

  1. ImageCat may ask you to provide personal information necessary to identify you so that we can offer you a better user experience.
  2. We undertake to collect, use, store, and manage your personal information in accordance with applicable laws and regulations and in a manner that ensures your secure and stable use of ImageCat. We will not disclose your personal information unlawfully.
  3. You agree that ImageCat may collect, use, store, share, and transfer personal information in accordance with the Privacy Policy.

7. Disclaimer

  1. ImageCat will endeavor to operate the Service stably. However, due to legal, policy, technical, economic, or management reasons, ImageCat shall not be liable if the Service becomes unavailable, interrupted, unsuitable for a specific purpose, delayed, insecure, unreliable, or contains errors, or if products, services, or materials obtained through the Service do not meet your expectations, or if user data is accessed or modified without authorization.
  2. ImageCat may permanently delete user data from its servers after account cancellation or service termination, except where otherwise required by law. In such circumstances, ImageCat may be unable to return or provide any data to you.
  3. You shall bear the consequences of your conduct while using the Service if such conduct violates laws, regulations, or policies.
  4. The services, products, or content we provide may be changed, suspended, interrupted, or terminated due to changes in laws, regulations, regulatory policies, requests of rights holders or copyright owners, product plans, or operational circumstances, and ImageCat shall be exempt from liability in such cases.

8. Notices

ImageCat may send notices to you by SMS, telephone, or announcements in prominent positions within the app. We may use one or more of these methods to notify you of amendments to service terms, service changes, or other important matters.

9. Breach of Contract

  1. If ImageCat violates applicable law or any provision of this Agreement and causes you loss, ImageCat shall bear the corresponding liability for damages according to law.
  2. If your violation of law or this Agreement causes loss to ImageCat or any third party, you agree to bear the resulting liability for damages.

10. Governing Law

Your use of ImageCat shall comply with the laws of the People's Republic of China, the laws of your place of residence, and any other laws applicable to you. The interpretation and performance of this Agreement shall be governed by the laws of the People's Republic of China.

11. Dispute Resolution

Any dispute arising out of the interpretation or performance of this Agreement shall first be resolved through friendly consultation. If consultation fails, either party may seek resolution through legal means, and this Agreement shall be legally binding on all parties.

12. Miscellaneous

  1. ImageCat may from time to time publish additional agreements applicable to users, which may supplement or amend this Agreement and become part of it.
  2. If any provision of this Agreement is held to be void, invalid, or unenforceable, that provision shall be severable and shall not affect the validity or enforceability of the remaining provisions.

为使用ImageCat APP 提供的相关服务（以下简称"本服务"），请你审慎阅读、充分理解本协议各条款内容，并选择接受或不接受本协议，特别是免除或者限制责任的条款、法律适用和争议解决条款。你的注册、登录、使用等行为将视为对本协议的接受，并视为你同意接受本协议各项条款的约束，本协议将构成你与"ImageCat"之间直接有约束力的法律文件。

如果你不具备中华人民共和国法律法规规定的与你行为相适应的民事行为能力，请在监护人陪同和指导下阅读本协议，并在使用本协议项下服务前取得监护人的同意。若你不具备前述民事行为能力，则你及你的监护人应依照法律规定承担因此而导致的一切后果。

请确认你依照中华人民共和国法律及你所在地之法律、以及你自愿或应当接受其管辖之法律，有权签署并同意接受本协议的约束。如果你代表你的雇主或单位，请确认并保证你已获得签署本协议的充分授权。

特别提示：本服务中涉及由人工智能模型提供的服务及内容，均为人工智能模型自动生成，可能出现错误或遗漏，我们对本服务生成内容的准确性、完整性和功能性不作任何保证或承诺，其生成的内容不代表我们的态度或观点。你在使用本服务涉及图片美化、AI 编辑等相关专业问题及内容时，并不能获得专业美学或版权服务等专业意见。若你需要该等专业意见，应咨询专业人士。我们无法承担你因使用本服务给你或任何第三方造成的损害或责任。

一、服务内容

  1. 本服务是指：我们通过ImageCat向你提供的文生图、参考图编辑、语音辅助输入、多轮图片创作、涂鸦编辑、前后对比、图片导出等功能和服务。我们可以对提供的服务内容予以变更，并对用户进行相应提示。
  2. 我们仅提供与ImageCat相关的技术服务，除此之外与你使用相关网络服务有关的设备及所需费用，均由你自行负担。

二、注册与登录

  1. 你可以通过 Apple、Google 或微信账号登录ImageCat。不同第三方登录方式分别视为独立的ImageCat账号，即使由同一人使用或关联了相同邮箱，也不会自动合并。
  2. 注册账号或授权登录时，请你按照ImageCat的提示及要求填写或提供资料、信息，并确保身份及信息的真实性、准确性和完整性；如资料发生变化，请你及时更改。你使用的帐号名称、头像等注册信息中不得出现违法和不良信息。
  3. 你应了解，当你注册成功并使用第三方账号登录ImageCat时，我们无法对非法或未经你授权使用该第三方账号的行为作出甄别，因此，ImageCat对任何使用你已登录账号使用ImageCat相关服务的行为不承担责任，但因我们过错导致的除外。
  4. 当你的账号遭到未获授权的使用，或者发生其他任何安全问题时，你应立即有效通知ImageCat。你理解ImageCat对你的任何请求采取行动均需要合理时间，且相关行动可能无法避免或阻止侵害后果的形成或扩大。
  5. 你在注册、使用账号时应承诺遵守法律法规、公共秩序、社会道德风尚和信息真实性等要求。
  6. 你应对注册帐号下的一切行为负责，并承担因使用内容而引起的所有风险。

三、用户使用

  1. 你同意秉承善意使用ImageCat，不会利用ImageCat进行非法活动或侵犯他人权利、损害他人利益的活动。
  2. 你不会以非法方式获取或利用其他用户的信息，不会以技术方式攻击、破坏或改变ImageCat的部分或全部，也不会反向工程、反向编译、反向汇编或改写ImageCat的任何程序。
  3. 未经许可，你不会使用ImageCat的名称、商标、商业标识、应用版式或内容，也不会侵犯我们的知识产权或其他合法权益。
  4. 除非另有授权，你不会将ImageCat用于商业目的。
  5. 如你违反上述约定，ImageCat可能将你违反法律或侵犯第三方权利的记录报告给行政主管部门或司法机关。
  6. 你上传的信息和图片不得包含违法内容、恶意程序、虚假误导信息或侵犯他人权利的内容。你上传的图片须确保拥有版权、肖像权或相关授权。

四、用户产生的内容

你在ImageCat以各种形式产生的一切信息，均应符合国家法律法规、平台规则、社会公序良俗，并不侵犯任何第三方主体的合法权益。如果我们发现你通过ImageCat产生的内容不符合前述规定，我们有权予以处理。

五、知识产权

  1. 我们对ImageCat服务及软件所包含的受知识产权法或其他法律保护的资料享有相应权利。ImageCat整体内容的知识产权归属我们，未经授权，任何人不得复制或作其他用途。
  2. ImageCat对其专有内容、原创内容和其他通过授权取得的独占或者独家内容享有知识产权。未经书面许可，任何单位和个人不得复制、转载、传播或提供使用服务。
  3. 你上传图片编辑结果的知识产权归你所有，但我们有权在法律允许范围内将相关数据用于内部优化。

六、隐私保护

  1. ImageCat可能需要你填写能识别用户身份的个人信息以便为你提供更好的使用体验。
  2. ImageCat承诺，将按照法律法规规定的方式以及保障你安全稳定使用ImageCat的方式收集、使用、保存、管理你的个人信息，不以非法方式披露你的个人信息。
  3. 你同意ImageCat按照《隐私政策》对用户个人信息进行收集、使用、保存、共享和转让。

七、免责约定

  1. ImageCat尽可能保证其稳定运行。你应理解并同意，因法律、政策、技术、经济、管理等原因，ImageCat不会因服务无法使用、中断、与用户需求不完全适配、运行不及时不安全不可靠、出现错误，或用户资料遭到未经授权的使用或修改等情形而承担责任。
  2. 如你注销ImageCat账号，或ImageCat所提供的服务终止或取消，ImageCat可以从服务器上永久删除用户数据。除法律有明确规定外，此种情形下，ImageCat无法向用户返还或提供任何数据。
  3. 你在使用ImageCat服务过程中应遵守国家法律法规及政策规定，你使用ImageCat服务而产生的行为后果由你自行承担。
  4. 你理解并同意，ImageCat向你提供的服务、产品或内容，可能会根据法律法规、监管政策、权利人要求、产品计划、运营情况等原因进行变更、中止、中断或终止，ImageCat对此免责。

八、通知

ImageCat向你发送的通知可通过短信、电话或在应用内显著位置公告等方式进行。ImageCat将通过上述方法之一向你传递服务条款修改、服务变更或其他重要事项。

九、违约责任

  1. 如因ImageCat违反有关法律、法规或本协议项下任何条款而给你造成损失的，相应的损害赔偿责任由ImageCat承担。
  2. 如因你违反有关法律、法规或本协议项下任何条款而给ImageCat或任何第三方造成损失，你同意承担由此造成的损害赔偿责任。

十、法律适用

你在使用ImageCat时，应遵守中华人民共和国法律、你所在地之法律以及你自愿或应当接受其管辖之法律。本协议的解释及履行应按照中华人民共和国法律进行。

十一、争议解决

因本协议解释或执行引起的任何争议，双方应首先友好协商解决。协商不成时，则任一方均可通过法律方式解决，本协议对各方均有法律约束力。

十二、其他

  1. ImageCat可能不时发布针对用户的相关协议，并可能将其作为对本协议的补充或修改，使其内容成为本协议的一部分。
  2. 本协议任一条款被视为废止、无效或不可执行，该条应视为可分的且并不影响本协议其余条款的有效性及可执行性。
